[성명] 위헌적인 상시적 인터넷실명제 폐지해야
- <미디어오늘>의 인터넷실명제 위헌 소송을 지지하며
정부가 포털, 인터넷언론사 등을 대상으로 강제로 실시하고 있는 제한적 본인실명확인제, 즉 인터넷실명제에 대해서 당사자인 온.오프라인 언론사인 <미디어오늘>이 지난 13일 위헌법률임을 청구하는 헌법소원을 제기하였다.
한국인터넷기자협회는 정부가 공직선거법 및 ‘정보통신망 이용촉진 및 정보보호 등에 관한 법률’을 통해서 강제화하고 있는 인터넷실명제가 우리 국민의 표현 및 언론의 자유를 아주 심각하게 침해해 오고 있다는 점을 지난 참여정부에서부터 헌법소원 등 강력하게 문제 제기해 왔다.
미디어전문지인 <미디어오늘>은 실명제 적용 당사자로서인 언론사 가운데 처음으로 정보통신망법상의 인터넷실명제에 대해서 위헌 소송을 제기하였다. 우리는 <미디어오늘>의 결단을 지지하며, 제한적 본인확인제로 포장된 ‘인터넷실명제’에 대해서 헌법재판소가 하루 속히 위헌 판결을 내리길 촉구한다.
정부는 인터넷 상의 명예훼손, 악플 등을 이유로 들어서 포털, 언론사 사이트 등 뉴스정보와 문화적 소통이 이루어지는 인터넷 주요 사이트의 댓글에 대해서 본인임을 확인해야 글을 쓸 수 있게 하는 인터넷실명제를 강제해 오고 있다.
그러나 이러한 인터넷실명제는 전 세계에서 유례를 찾아볼 수 없는 반인권적, 위헌적 악법이다. 인터넷실명제의 근간이 되고 있는 주민등록번호 제도는 이미 심각하게 악용되고 있다. 중국발 해킹 등 대규모 사이트 해킹으로 인해 유출된 국민 개개인의 주민번호와 개인정보가 ‘건당 1원’으로 거래되고 있는 웃지 못 할 사건이 자주 벌어지고 있다. 자신의 주민번호가 상업적으로 거래되고 도용되는 실정에서 주민번호를 근간으로 한 인터넷실명제는 그 효력을 이미 상실했다 할 것이다.
더욱이 최근 전 세계적으로 불고 있는 페이스북, 트위터와 같은 쇼셜 네트워킹 서비스(SNS)를 보면 실명제가 왜 필요한지 의문이 들 수밖에 없다. 구글메일, 트위터 계정 등은 주민등록번호와 같은 실명확인을 기반으로 하지 않는다. 당연히 인터넷 상에서 익명으로 네트워크를 형성할 권리가 보장된다. 그렇다고 해서 이들 국제적 기준의 서비스가 문제가 된다는 소리를 우리는 들어본 바가 없다.
우리나라의 인터넷실명제는 국제적 흐름과 기준에도 부합하지 않는 전근대적인 낡은 규제일 뿐이다. 인권을 침해하며, 언론사의 자유를 저해하며, IT강국으로써의 국제적 발전에 걸림돌이 되는 제도가 바로 인터넷실명제이다.
한국인터넷기자협회는 인터넷 상의 명예훼손과 인권침해를 결코 옹호하지 않는다. 일부 네티즌들에 의해서 생성, 확산되는 반인권적 표현이나 악의적 비방은 근절되어야 하며 우리 사회가 나서서 성숙된 인터넷 문화를 만들어야 한다는 사실을 잘 알고 있다.
그러나 인터넷실명제의 효과는 오히려 표현의 자유를 위축하며 악플, 비방 등을 차단하는 효과도 극히 미비함이 여러 연구결과로 속속 확인되고 있다. 한국의 네티즌들이 구글메일, 트위터 등으로 빠져나가는 이유는 과연 무엇인가? 주민번호 도용과 개인정보 유출, 해킹, 표현의 자유 제한을 걱정할 필요가 없기 때문이다. 이처럼 소탐대실, 빈대 잡으려다 초가삼간 태우는 우를 범하는 것처럼 한국의 인터넷실명제는 오히려 우리 사회가 선진 인터넷 강국을 주도하는 데 걸림돌이 되고 있다.
애플이 아이폰, 아이패드로 전 세계의 모바일, 인터넷 지형을 뒤흔들고 있는 사이, 우리나라는 인터넷실명제, 포털 독과점 등과 같은 잘못된 정책과 미디어 환경으로 인해서 창의적인 인터넷 미디어 시장이 발전하지 못하고 있다.
<미디어오늘>의 인터넷실명제 위헌 소송을 계기로, 차제에 정부와 정치권은 반인권, 위헌적이며 시장 발전에 암초인 ‘강제적인 상시적 인터넷실명제’를 폐지해야 할 일이다. 또한 당국의 트위터에 대한 선거법 규제와 같은 세계적 웃음거리 짓도 당장 멈춰야 한다. 헌법재판소 역시 위헌적이며 국제적 기준에도 맞지 않는 인터넷실명제에 대해서 위헌 판결을 내려야 한다.
한국인터넷기자협회는 다시 한 번 <미디어오늘>의 인터넷실명제 위헌 소송을 전폭적으로 지지하며 위헌 판결을 받는 그날까지 함께 연대할 것을 천명한다.

요번 국회의원 보궐선거서 5:3으로 한나라당이 승리했다하지만 내용을 살펴보면
한나라당의 패배나 진배없는것으로
군사독재처럼 방송장악과 친일매국신문 조중동지원과 선거법위반인 유급알바 500명 고용 여론조작하고
선관위도 경상도태생을 주요보직에 많이않혀 부재자표 바꿔치기등 부정선거로 과거 독재시대처럼 만들었고
공천문제에서 민주당 대표지도부와 지역도지사나 인천시장과의 불협화음으로
약점많은 제3자가 늦게 공천받았고 또 단일화도 선거 바로 2.3일전등 약점이 많았으며
예로부터 인천은 보수성향의 한나라당 텃밭이었고
충주역시 충청북도중 특이하게 보수성향이 강한 한나라당텃밭에 4대강죽이기 공사인 4대강개발로
충주호와 남한강을낀 지리적 여건에 혹시라도 땅값상승이나 충주시가 개발되려면 한나라당이 뽑혀야할것같은 기대감으로
강물과 지하수 썩건말건 지역이기주의로 한나라당을 뽑은것이지 한나라당이 잘해서 뽑은것이 아니며
천안은 지역당이며 이것도 저것도 아닌 보수잡탕당 이회창당과 한나라당의 보수색깔이 비슷한당을 뽑은것이며
은평구역시 은평뉴타운이란 공약에 은평구에 한나라당 실세가 뽑히면 은평구가 발전될것같다는 지역이기주의인것이며
보수성향이었던 강원도에서 세곳중 두곳 승리는 강원도를 민주적인 개혁적으로 바꾸는 승리라할수있다
물론 휴전선 최전방 철원,화천지역은 안보를 핑계로 주민들의 이념공세가 수구늙은이들처럼 머리속에 박힌지역이라 어쩔수없고
저번 지방선거처럼 부재자표 바꿔치기와 방송장악 편파보도와 유급알바단속등 앞으로 편파적인 선관위를 공정하게 바꾸는 대책이 시급하다
물론 민주당대표와 이번 선거 지방책임자와 불협화음은 분명 정세균대표가 책임지고 물러나야하며
그것이 수권정당의 책임지는 자세라할수있고 책임자 교체가 곳 민주정당의 실체로 국민지지를 받을수있고
요번 불법선거 승리를 한나라당이 또 오만하게 받아들이며 4대강죽이기나 부패정치강행에 이용하려하지만
국민들도 환경법 하천법 국가예산법위반 불법인 4대강죽이기공사 책임을 청와대와 내각 특혜공사업체와 한나라당지도부에 분명 물을것이며
사기공갈등 부패전과14범처럼 시장서 어묵먹으며 서민위하는척 쑈하며 한나라당도 요즘 서민위하는척 하지만
진정 서민위한다면 재벌부자 감세한걸 도로 원위치시키고 복지예산을 늘려야하지만 그건 그대로두고 서민속이는짓으로
대기업 편들기로 중소기업 파탄만들고 부자재벌위한 감세후 부족분을 서민과 국민복지예산삭감과
자동차 유류세.전기,수도,까스 의료보험 학자금과 재산세등등 일반국민 세금올리고
미국위한 환율인상과 세계최고 무기수입과 주한미군퍼주기와 일본위한 적자무역만들어 1700조이상 외국빚만들고
대기업과 짜고 정규직법도 무시 비정규직양산 실업자늘리고 월급은 오히려 깍으며 물가나 수업료 또 일반세금올려
길거리서 휴지주워 연명하는 사람많듯이 생계곤란 자살1위국에 자식낳아 고생시킨다고 세계최저출산국만들고도
영세민과 노인 장애인등 사회적약자와 학교나 병원지원 복지예산을 깍으며 서민위하는척 사기치는
정경유착 부패재벌과 짜고 차떼기로 세금도둑질하는 차떼기당에 속지말아야한다
중요한 과제는 과거 차떼기당의 부정부패와 부정축재로 IMF만들듯 현재 경제망쳐 다른당 의원과 일반국민들 재산이 엄청줄었는데
4대강특혜업체나 부패재벌위한 악법추진과 방송언론장악법과 미국무기수입업체나
미국인 않먹는 광우위험소수입업체 편들었다고 업체나 부패정권서 로비성 뇌물받았는지
나라는 빚더미만들고 한나라당이 시,군,도지사 맡았던 지방도시도 주민세금 펑펑써 빚더미인데도
