전두환 군사독재정권이 친북용공 사건으로 조작해 낸 '아람회' 사건 피해자들에게 29년만에 재심 법원이 무죄를 선고했다.
아람회 사건은 80년 전두환 군사정권 당시 이 사건으로 기소되었던 김란수씨의 딸 아람이의 백일잔치에 충남 금산중학교 동창생들인 박 회장 등이 모여 반국가단체를 결성했다고 해서 수사기관이 붙인 사건명이다.
박 회장 등 아람회 사건 피해자들은 당시 전두환 신군부의 고문조작 수사를 받고 '전두환 광주 살육작전' 등의 유인물을 충남 금산 등 이 지역에 유포한 혐의 등으로 기소돼 각각 징역 1년 6월∼10년 선고를 받아 억울한 옥살이를 하다가 지난 88년 특별사면되었다.
<파이낸셜뉴스> 등 언론보도에 따르면, 서울고법 형사3부(재판장 이성호 부장판사)는 21일 오전 10시 아람회 사건 재심 선고 공판에서 80년 당시 계엄법 위반 혐의 등으로 기소돼, 무고한 옥살이를 했던 박해전(54) 현 인터넷신문 <참말로> 회장 등 5명에 대해서 원심파기와 더불어 무죄를 선고했다.
재판부는 선고 판결문에서 "아람회 사건은 신군부 세력이 자신들의 취약한 권력기반의 안정을 꾀할 목적으로 교사, 군인, 경찰공무원, 대학생, 주부 등 평범한 시민들로 이뤄진 친목계를 반국가단체로 몬 용공조작 사건"이라고 확정했다.
재판부는 "따라서 신군부의 헌정질서 파괴행위에 맞서 헌법과 민주주의를 수호하려던 피고인들에게 유죄 판결한 원심을 파기한다"며 "계엄법, 반공법, 국가보안법 위반에 대해서는 무죄를, 집회및시위에관한법률 위반에 대해서는 면소"를 판결했다.
재판부는 이날 선고에서 전두환 신군부가 조작한 용공사건에 대해 당시 유죄를 선고했던 재판부를 대신해 깊은 사과를 표명했다. 재판부는 "법치주의의 최후 보루인 사법부가 당시 진실을 외면하며 제 역할을 다하지 못했다"며 "선배 법관들을 대신해 억울하게 고초를 당하고 힘든 여생을 살아온 피고인들에게 심심한 사과와 위로를 밝힌다"고 말했다.
박해전 회장은 지난 88년 한겨레 신문 창간 과정에 참여했으며 이 신문에서 여론매체부장을 지냈다. 지난 2002년 5월 한겨레 독자참여지면에서 기획한 노사모 열풍 기사 불게재에 항의해 편집국에 사표를 냈다. 이후 박 회장은 한국인터넷기자협회 창립발기인으로 참여해 인터넷기자협회를 창립했으며, 부회장을 지낸 바 있다. 인터넷신문 <참말로>를 창간하였으며 현재 이 신문의 회장으로 활동하고 있다.
