최근 인터넷 포털 매체와 이용자와 관련한 두 가지 의미 있는 판결이 있었다. 하나는 헤어진 여자 친구의 자살 책임이 남자 친구에게 있다는 언론보도 등으로 쏟아진 네티즌들의 비난과 인적 사항 공개 등으로 직장마저 잃게 된 김명재씨가 네이버, 다음 등 인터넷 포털을 상대로 제기한 명예훼손 손해배상 청구소송의 대법원 판결이다. 또 하나는 이명박 정권의 경제정책을 집중적으로 비판하면서 실물경제와 전망 등에 관한 수백 건의 미디어다음 아고라 게시판 등에 게재했던 미네르바 박대성씨에 관한 판결이다.
김명재씨의 소송과 관련 대법원은 포털의 게시물에 관한 관리책임을 들어 고등법원의 판결이 정당하다며 네이버, 다음 등 포털 사이트들에게 3천만원의 손해배상 책임을 확정했다.
미네르바 관련 재판은 법원이 미네르바 박대성씨의 손을 들어주었다. 검찰은 전기통신기본법상의 공익을 해할 목적으로 허위사실을 유포했다며 전기통신기본법 위반 혐의로 박씨를 기소했지만 법원은 허위사실임을 인식하지 못했을 뿐 아니라 공익을 해할 의도가 있었다고 보기 어렵다며 무죄를 선고했다. 검찰은 즉각 항소 의사를 밝히고 항소했다.
이 두 가지 판결은 서로 소송의 제기 과정 등이 다른 사건이지만 모두 다 인터넷 포털의 게시물과 관련한 판결로서 중요한 의미를 지닌다.
전자는 인터넷 포털 게시물의 명예훼손 등 이용자의 인격권 침해와 피해에 관한 첫 대법원 판례라는 점에서, 후자는 정부 정책 등에 관한 이용자의 게시물의 표현의 자유에 대한 법원의 무죄 판결이라는 점에서 그렇다.
그러나 두 판결을 바라보는 이해당사자와 언론계의 입장은 간단치 않다. 먼저 김씨 사건의 대법원 판결에 의해 손해배상의 책임을 지게 된 포털 측은 판결 결과에 대해 만족치 않고 있다. 앞으로 유사 사건이나 소송 등에서 자칫 모든 게시물에 대한 관리 책임을 포털에 지우는 것이 아닌가 하는 극단적인 우려를 하고 있다. 이에 반해서 명예훼손과 사생활 침해 등의 피해로부터 포털의 배상책임을 물리게 한 원고 측과 소송대리인, 관계자 등은 포털의 책임을 명확히 했다는 측면에서 대법원의 판결을 크게 환영하고 있다. 이번 판결을 보면서 우선 확인해야 할 사항이 있다. 게시판 등 포털 매체 역시 대한민국 사법 체계 안에 있다는 것이며 법적 규범과 의무, 책임으로부터 결코 자유롭지 않다는 사실이다. 학계 등 일부 전문가들은 미국 사법부의 판례의 예를 들어서 포털 게시물에 대한 과도한 정부 규제와 법적 제재는 자유로운 인터넷 공간을 위축시킬 수 있다는 우려를 한다. 타당한 지적이다. 이들은 정부의 규제와 간섭, 개입보다는 자율적 규제모델을 선호한다.
그러나 자율적 규제 모델이 모든 것을 해결할 수는 없는 일이다. 포털에게 모든 게시물에 대한 과도한 사전 검열이나 일상적인 모니터링의 의무를 부과하는 것은 바람직하지 않은 일임에 틀림없다. 하지만 이런 논리 등을 앞세워 포털의 이용자들의 인격권 침해나 피해를 방치하는 일도 옳지 않다. 양자의 적절한 조화가 필요하다. 김씨 사건에 대한 대법원 판례에서 우리가 확인해야 할 일은 포털 역시 언론매체로서 그에 따르는 사회적 책임과 의무를 반드시 이행해야 한다는 사실이다. 현재 포털은 ‘공공매체의 적’으로까지 불리울 정도로 과도한 뉴스권력 형성으로 비판을 받고 있다. 포털권력의 힘은 이용자와 자유로운 인터넷 문화의 힘으로부터 나오는 것은 사실이지만, 그에 따르는 사회적 책무를 방기하고 외면할 때 결국은 사법적 책임을 지게 된다는 사실을 인정해야 한다.
이번 김씨 사건에 관한 대법원 판결은 포털 매체의 사회적 책임을 명확히 한 판결로 인터넷 이용자와 포털이 게시물 글쓰기 등 자유로운 이용에 있어서 져야 할 책임과 권리에 관한 단초를 제공했다고 할 수 있다. 또 하나의 주어진 숙제도 있다. 개인 또는 공인에 관한 인터넷 매체 공간을 통한 비판과 여론 형성 등에 있어서 김씨 사건 대법원 판결 이전과 이후의 문제점과 과제는 무엇인지 점검해 볼 필요가 있다. 그것이 언론의 역할이다. 포털 측은 무조건 억울하다고 할 일이 아니며 반면 일부에서 무조건 포털의 책임이 크다는 식의 생각을 고정화해서는 안 된다. 이 모두 인터넷 문화의 일부 잘못된 행태가 빚어낸 결과물이기 때문이다. 그 원인을 제대로 파악하고 처방책을 낼 수 있도록 언론계 등 각계가 노력해야 한다.
미네르바 박씨에 관한 1심 법원의 무죄판결은 이용자의 자유로운 글쓰기와 표현의 자유를 옹호했다는 데에 역사적 의의가 있다. 애초 전기통신기본법 위반을 적용하고자 한 검찰의 다분히 정치적인 판단은 무리가 있었다고 본다. 만시지탄의 결과가 나온 것은 당연한 일이다. 이 일을 계기로 이명박 정부는 지난 해 촛불 정국 이후 계속되어온 인터넷 공간에 대한 일련의 규제강화 정책을 되돌아보는 등 발상의 전환을 해야 한다. 최근 구글과 유튜브에 대한 인터넷 실명제 적용 논란에서 드러나듯 한국의 일부 잘못된 인터넷 규제 정책은 전 세계로부터 비난을 받고 있다. 국제적 기준과 세계화를 부르짖는 대한민국 정부가 인터넷 정책에서만 거꾸로 시계를 돌리고 있는 것은 퇴행적인 일이 아닐 수 없다.
그러나 미네르바 박씨의 모든 행위를 옹호하고 싶은 생각은 없다. 만약 그가 저널리스트였다면 ‘긴급 공문 발송’ 등의 용어를 사용하지는 않았을 것이다. 패러디일지라도 때와 상황에 따른 적절한 방식의 글쓰기가 필요하다. 근본적인 책임이 이명박 정권의 과도한 인터넷 규제와 네티즌 탄압에 있다 하더라도 그러한 빌미를 일부 제공한 박씨의 글의 ‘옥의 티’는 앞으로 개선되어야 할 것으로 본다. 탄압의 감옥을 빠져나온 미네르바가 더욱 성숙한 지혜의 여신으로 돌아올 것으로 믿는다.
앞서 두 가지 법원의 판결을 보면서 현재 국회에서 진행되고 있는 문방위 산하 미디어발전위원회 위원들의 미디어 관련법 논의에서 특히 첨예하게 부딪치고 있는 인터넷 규제 정책에 관한 논의에서도 합의가 모색되었으면 한다. 여론의 다양성을 훼손하는 미디어권력이라고 할 수 있는 포털에 관한 적절한 사회적 책임을 지우는 ‘필요한 대목’에서의 규제는 불가피하다. 그러나 모든 인터넷 이용자들의 모욕죄로 옭아맬 수도 있는 ‘사이버모욕죄’ 같은 악법은 철회되어야 한다. 필요한 규제는 수용하되, 표현의 자유는 지킬 수 있는 합의안이 미디어위원회 안에서 나오길 바란다.
